Beschreibung:
In order to transform the WIPO treaty and EC regulatory law into
national law, the German Parliament will start negotiating a new
copyright law this autumn. The draft version backs the implementation
of digital rights management systems and criminalises the breaching of
technical barriers such as encryption and anti-circumvention measures,
thus making illegal the copying of materials for “fair use“. The draft
version seems to follow the 1998 US Digital Millenium Copyright Act
(DMCA). In doing so it runs the risk of triggering the same unintended
consequences that have already occurred in the US. It threatens to
- eclipse the public domain by overestimating private interests
- weaken the innovation system of the knowledge society

The problems caused by rigid copyright laws and patents have been
discussed in the US and in Europe for years. Yet those debates have to
be carried beyond the present confines if they are to lead to a more
comprehensive notion of the future of the Global Commons in a
globalised world. Issues such as intellectual property rights policy
and development policy have to figure in the debate. Securing and
extending the Global Commons offers a great opportunity to bridge the
digital divide. Should it succeed, the vision of an equally shared
basis for the overall development of intellectual creativity,
technological innovation, effective technology use, and successful
participation in the knowledge society might become reality.

The conference will be the starting point of the Heinrich Böll
Foundation’s campaign on the road to the World Summit on Information
Society taking place in Geneva in 2003 and Tunis in 2005.
