How does the text scroll? Horizontally or Vertically?
Why is the scrolling text not a good idea--what specifically merits that
this is a bad thing? What type of site is it? I can name several sites off
the top of my head that DO scroll on their home page (and others) and can
give justification for it, but I'm afraid that, from where I sit, it is
pretty difficult to make a call without some additional information.
Perhaps you can even post a generic wireframe that better illustrates what
you're dealing with?

Folk, please help. It's awful that my new client doesn't believe me.
Although she took most of my usability and navigation suggestions for the
new site she's developing, the scrolling text on the home page is still
there. The text is a law that formed the basis for the whole site being
built--I don't want to mention the name because the site is still in
development. In other words, this text is pretty important.
And get this: the box in which the text scrolls has a title over it. The
title is: "Interesting, Isn't It?"
Arrrrrgggghhh!
If I could give her some "official" opinions, perhaps she'd change her mind.
