prior art and market size are your friends, at least until the patent  
office recognizes the silliness of  many of these claims.

creative is attacking the ipod in every way possible because of the  
size of the market.

fwiw, copyright should apply here in my view, not patent. james  
gleick had a good illustration the NYT Magazine some time ago  
illustrating a patent on walking. it had as much validity as this.
